Consideration of a Hackney Carriage & Private Hire Driver Licence

The applicant was present.
The Licensing Enforcement Officer introduced the report which asked the Panel to consider an application for a Hackney Carriage and Private Hire Driver’s licence where there were previous criminal convictions.
That the applicant is a fit and proper person to be licenced to drive a Hackney Carriage and Private Hire vehicle. The Panel has therefore decided to grant the licence.
Reasons for decision
The Panel have carefully considered the representations made by all parties and gave due regard to all of the following documents in reaching its decisions:
1. The application
2. Report prepared by the Licensing Enforcement Officer
3. East Northamptonshire Council Taxi Licensing Policy
4. East Northamptonshire Council Taxi Criminal Records Policy.
The reason for the decision is that the applicant is considered to be a fit and proper person to hold a licence.
The Panel noted the applicant’s acceptance of the offences and their openness during the hearing.
On 5 January 2023, the applicant applied for a hackney/private hire licence. On the application the applicant failed to disclose a number of previous convictions. A DBS check revealed that the applicant had a number of previous convictions for serious offences during the period 1997 – 2008. The last conviction was of some age, 15 years ago.
At the Panel, the applicant was honest and open and volunteered information about their criminal past and their failure to complete the application form correctly, as they believed that the DBS check would reveal the previous convictions.
The applicant has a right of appeal within 21 days from receiving the decision to the Magistrates Court if they are aggrieved by this decision.
