Exclusion of Press and Public

That in accordance with section 100(a) of the Local Government Act 1972 the press and public will be excluded from the meeting during consideration of the following items on the grounds that they would involve the likely disclosure of exempt information of the description shown in Part 1 of Schedule 12A to the Act.

Consideration of the Personal Licence of an individual under the Licensing Act 2003

To suspend the Personal Licence for 12 weeks.

The licence holder was present.

 

The Licensing Enforcement Officer introduced the report which asked the Sub-Committee to consider two relevant convictions that the Authority had been made aware of during the life of a Licensing Act 2033 Personal Licence.

 

RESOLVED:

 

To suspend the Personal Licence for 12 weeks.

 

Reasons for decision

 

The Sub-Committee expressed concern that as a Personal Licence Holder, the licence holder had two convictions that involved the consumption of alcohol and questioned the licence holder on how this demonstrated his ability to uphold the licensing objectives, specifically in relation to the prevention of crime and disorder and public safety. The licence holder explained that his most recent conviction occurred when he had an accident the day after consuming alcohol and was found to be over the limit at the scene of the accident. The licence holder stated that he had genuinely believed he was not over the limit when he got into his vehicle.

 

The Sub-Committee considered the options available to it under the Licensing Act 2003. The Sub-Committee agreed that in the circumstance it was not appropriate to take no action.

 

The Sub-Committee acknowledged the discretionary power available to them to suspend the Personal Licence under the Policing and Crime Act 2017 for a period not exceeding six months.

 

It was unanimously resolved by the Sub-Committee that the licence holder’s Personal Licence should be suspended for a period of 12 weeks.
