Licensing Act 2003 - Review of Premises Licensing Presented By: Health Services Manager Additional documents:
Minutes: The report was brought before the committee to consider an application for a review of the licence under the Licensing Act 2003 in relation to the premises known as The Angel Hotel trading as Decades, Carrington Street, Kettering. The panel heard that there had been changes to the Licence in the time period between the originally scheduled hearing to the date of this hearing. All members confirmed they had received these updates. It was heard that the Environmental Team Leader had attended the premises and that the findings made were detailed in the Review document (Appendix A). The panel then heard from the Licence Holder and their representatives. It was confirmed that the Licence Holder was not in support of the review and questioned the process in which the review was being undertaken. The Chair confirmed that the process would be followed as planned. Mr Cross addressed the committee regarding the allegation noted in the report. The panel took advice to allow this address to take place, with the view that the explanation would lead to a description of the alleged breach. The Licence Holder explained that in order to prevent Crime and Disorder, the external doors were left open, therefore it is ‘practical’ for these to be so. The Licence Holder’s representatives heard that further measures had been taken place to reduce noise. - Bar 7 doors permanently closed. - Queue direction changed at Decades. - Purchased and used a sound level metre. Should there be an incident of excessive noise it is dealt with. - Record of noise complaints received, of which there have been 0. - Bar 7: third inner door installed to create an additional lobby. - Automatic closers had been upgraded to allow doors to close faster. - Strips on doors improved. - Air vents boarded up. - Perspex installed as a third level of glazing on windows. - Extra member of security on Friday and Saturday nights - Sound limiter in place.
The licence holder’s representatives asked the panel to consider proposed changes and additional conditions sent by them the day before the meeting. With regards to Condition 9: “The licence holder or a person nominated in writing shall regularly check the surrounding area when licensable regulated entertainment is taking place after 21:00 to ascertain if there is noise breakout from licensable regulated entertainment that is likely to cause a public nuisance. In the event that such is identified, action will be taken to reduce the sound level.” it was advised that this condition goes beyond the concept of keeping the doors closed, and promotes the licencing objectives of the Authority, leading to a positive and proactive way of dealing with any matters. Condition 10: “The Licence Holder shall provide contact details to any local resident who requests them, including an email address and the telephone number indicated in condition 23”.
